phearn Terms & Conditions – User Agreement
and Platform Rules for Philippine Players

1. Acceptance of Terms

By registering an account, accessing the phearn platform, depositing funds, placing wagers, or using any phearn services, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions, our Privacy Policy, and all applicable laws and regulations governing online gaming in the Republic of the Philippines. If you do not agree with any provision of these terms, you must immediately cease using the phearn platform and close your account.

We reserve the right to request proof of age at any time, and failure to provide satisfactory verification will result in account suspension and forfeiture of funds.
• Legal Capacity: You must possess the legal capacity to enter into binding contracts under the laws of the Republic of the Philippines and your jurisdiction of residence.

• Single Account Policy: You are permitted to maintain only one (1) account with phearn. Multiple accounts, duplicate accounts, or accounts created to abuse bonuses or promotions are strictly prohibited and will result in closure of all associated accounts and forfeiture of all balances.
• Self-Exclusion Compliance: You must not be subject to any self-exclusion, ban, or restriction from gambling activities, whether self-imposed or imposed by any regulatory authority.

3. Account Registration and Security

3.1 Account Creation

To access phearn gaming services, you must create a user account by providing accurate, complete, and truthful information including but not limited to your full legal name, date of birth, residential address, valid email address, and mobile phone number. You agree to immediately update your account information if any details change to ensure accuracy at all times.

3.2 Account Security

You are solely responsible for maintaining the confidentiality of your phearn account username, password, and any other security credentials. You must not share your account credentials with any third party. Any activity conducted through your account, whether authorized or unauthorized, is your sole responsibility. You agree to immediately notify phearn of any suspected unauthorized access, security breach, or use of your account. phearn is not liable for any losses resulting from unauthorized account access caused by your failure to maintain account security.

3.3 Account Verification

phearn reserves the right to request identity verification documentation at any time, including but not limited to government-issued identification, proof of address, payment method verification, and source of funds documentation. You agree to provide requested documents within the specified timeframe. Failure to complete verification may result in account suspension, withdrawal restrictions, or account closure. All submitted documents must be authentic, valid, and clearly legible. Submission of false, forged, or altered documents will result in immediate account termination and reporting to relevant authorities.

4. Deposits, Withdrawals, and Financial Transactions

4.1 Deposits

phearn accepts deposits through approved payment methods including GCash, Maya, bank transfers, and other methods displayed on the platform. All deposits are processed in Philippine Pesos (PHP). Minimum and maximum deposit limits apply as specified on the platform. You are responsible for all fees charged by your payment provider. Deposited funds are intended solely for gaming purposes on the phearn platform. phearn reserves the right to refuse deposits from any source or payment method at our sole discretion.

4.2 Withdrawals

Withdrawal requests must be made through the phearn platform using approved withdrawal methods. Withdrawals are processed to the same payment method used for deposits unless otherwise approved by phearn. Minimum and maximum withdrawal limits apply. Withdrawal processing times vary by payment method and may require additional verification. Withdrawals may be delayed or declined if account verification is incomplete, if we suspect fraudulent activity, money laundering, bonus abuse, or terms violations. All withdrawal requests are subject to review and approval by phearn's finance and compliance teams.

4.3 Anti-Money Laundering Compliance

phearn maintains strict anti-money laundering (AML) and know-your-customer (KYC) policies in compliance with Philippine law. We reserve the right to monitor, investigate, and report suspicious financial transactions to relevant authorities. Players must wager deposited funds at least one (1) time before withdrawal requests will be processed. Unusual transaction patterns, rapid deposits and withdrawals without gameplay, or other suspicious activity may trigger additional verification requirements or account restrictions.

5. Bonuses, Promotions, and Wagering Requirements

phearn reserves the right to suspend, restrict, or permanently close accounts at our sole discretion if we determine that terms have been violated, fraudulent activity has occurred, or account security has been compromised. In cases of account closure for violations, all funds, bonuses, and winnings may be forfeited.

8. Game Rules, Results, and Disputes

All games available on the phearn platform are provided by licensed third-party game providers and operate using certified Random Number Generators (RNG) to ensure fairness and unpredictability. Game rules, payout structures, and return-to-player (RTP) percentages are displayed within each game. phearn does not control, manipulate, or influence game outcomes. In the event of a technical malfunction, network disruption, or software error that affects game results, phearn reserves the right to void affected bets and refund stakes.

If you believe a game has malfunctioned or a dispute has arisen regarding game results, payouts, or account activity, you must notify phearn customer support immediately. All disputes must be reported within seven (7) days of the disputed event. phearn will investigate all legitimate disputes and render a final decision based on available evidence including game logs, transaction records, and system data. phearn's decision regarding disputes is final and binding.

9. Intellectual Property Rights

All content, materials, software, graphics, logos, trademarks, service marks, trade names, and other intellectual property displayed on the phearn platform are the exclusive property of phearn, our licensors, or third-party content providers and are protected by Philippine and international intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the phearn platform solely for personal, non-commercial entertainment purposes. You may not reproduce, distribute, modify, transmit, display, perform, publish, license, create derivative works from, transfer, or sell any content obtained from the phearn platform without express written permission.

10. Limitation of Liability

To the maximum extent permitted by applicable law, phearn, its owners, directors, employees, affiliates, partners, and service providers shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising from your use of the platform, including but not limited to loss of profits, loss of data, loss of goodwill, or service interruptions. phearn's total liability for any claim arising from or relating to the platform shall not exceed the total amount deposited by you into your phearn account during the three (3) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless phearn, its affiliates, directors, officers, employees, agents, and service providers from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from: (a) your violation of these Terms & Conditions; (b) your violation of any applicable law or regulation; (c) your violation of any third-party rights; (d) any unauthorized use of your account; or (e) any fraudulent, illegal, or harmful activity conducted through your account.

12. Governing Law and Dispute Resolution

These Terms & Conditions shall be governed by and construed in accordance with the laws of the Republic of the Philippines without regard to conflict of law principles. Any dispute, controversy, or claim arising from or relating to these terms, the phearn platform, or your use of phearn services shall be resolved through good faith negotiation between the parties. If negotiation fails to resolve the dispute within thirty (30) days, the parties agree to submit the matter to binding arbitration in accordance with the rules of the Philippine Dispute Resolution Center, Inc. The arbitration shall be conducted in Metro Manila, Philippines, and the arbitrator's decision shall be final and binding.

13. Severability

If any provision of these Terms & Conditions is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be severed from these terms, and the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be replaced with a valid, legal, and enforceable provision that most closely reflects the original intent of the parties.
